Dificuldades do inglês jurídico
A principal dificuldade na tradução de termos jurídicos em inglês é a diferença entre os sistemas.
O sistema jurídico brasileiro é romano-germânico, no qual o Direito é organizado em códigos. Já o sistema jurídico adotado pelos Estados Unidos, Canadá, Reino Unido, País de Gales, Irlanda, Austrália e Nova Zelândia, entre outros, é o jurisprudencial, no qual o Direito é baseado em precedentes que vinculam futuras decisões. No entanto, devemos ressaltar que os Estados Unidos possuem um sistema misto.
Seguem algumas características destes sistemas jurídicos:
Sistema romano-germânico
- Também conhecido como civil law
- Tradição escrita
- Fonte principal: legislação (códigos e leis) - (legislation)
- Fonte secundária: jurisprudência
- Regra abstrata aplicada a um caso concreto
- Criadores/autores: legislador

As diferenças apontadas acima acabam por dificultar as traduções, pois nem sempre um termo tem seu equivalente no outro sistema. Sendo assim, as traduções jurídicas não trabalham apenas com sinônimos perfeitos, mas empregam termos "semelhantes". Podemos afirmar que muitas vezes chegamos a uma tradução pela correspondência conceitual entre os termos.
